1. Acceptance of Terms

By accessing or using Miso ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Age Requirements

You must be at least 13 years old to use the Service. If you are under 18, you must have parental or guardian consent to use the Service.

3. Description of Service

Miso is an AI-powered assistant that helps users organize information, track personal data, and connect with third-party services. The Service includes web and mobile applications, cloud storage, and related features.

4. Medical and Wellness Disclaimer

Miso provides general wellness, nutrition, and informational content only. It is not a medical device, and it does not provide medical advice, diagnosis, or treatment. Miso makes no diagnosis and no treatment claims, and nothing it tells you is a substitute for the judgment of a qualified healthcare professional.

The calorie, macronutrient, and other health information Miso generates (including estimates derived from your food descriptions, photos, and connected health data) is produced by automated AI systems and may be incomplete or inaccurate. Do not rely on it for medical, clinical, or health decisions.

Always consult a physician, registered dietitian, or other qualified professional before making changes to your diet, exercise, or health regimen, and never disregard or delay professional medical advice because of something Miso told you. If you think you may have a medical emergency, call your doctor or your local emergency services immediately.

Miso is not intended for the diagnosis, cure, mitigation, prevention, or treatment of any disease or health condition.

5. User Accounts

To use certain features of the Service, you must create an account. You agree to:

• Provide accurate and complete information

• Maintain the security of your account credentials

• Notify us immediately of any unauthorized access

• Accept responsibility for all activities under your account

6. User Content

You retain ownership of content you create using the Service. By using the Service, you grant us a license to host, store, and display your content as necessary to provide the Service.

AI-Generated Content: Content generated by our AI features is owned by you. Calorie, macronutrient, and health estimates the Service produces are AI-generated and may be inaccurate, incomplete, or wrong. You are responsible for reviewing AI-generated content before you act on it, and you should not rely on it for medical or health decisions. See Section 4 (Medical and Wellness Disclaimer).

You agree not to create content that:

• Violates any applicable laws or regulations

• Infringes on intellectual property rights

• Contains malicious code or harmful content

• Harasses, threatens, or harms others

7. Acceptable Use

You agree not to:

• Use the Service for any illegal purpose

• Attempt to gain unauthorized access to our systems

• Interfere with or disrupt the Service

• Reverse engineer or decompile the Service

• Use automated systems to access the Service without permission

8. Subscription and Payment Terms

Miso offers both free and paid subscription tiers.

Free Tier: Limited access to AI features and basic functionality.

Paid Subscription (Miso Plus):

• Billed monthly at the rate displayed at time of purchase

• Automatically renews unless cancelled at least 24 hours before the end of the current billing period

• If you subscribe via the iOS app, manage your subscription through the App Store

• If you subscribe via the web, manage your subscription at withmiso.ai/settings

• No refunds for partial subscription periods

Price changes will be communicated in advance, and you may cancel before the new price takes effect.

9. iMessage and Text Message Communications

Miso is delivered primarily through iMessage and SMS text messages via a third-party messaging provider. By providing your phone number (whether on our website, in the iOS app, or by texting our number directly), you consent to receive recurring automated text messages from Miso at that number, including messages sent using an automatic telephone dialing system or similar technology. These messages include:

• Responses to your incoming messages

• Recurring reminders, check-ins, summaries, and follow-ups about your tracked data

• Account updates, subscription changes, and trial notifications

Consent to receive these messages is not a condition of purchasing any goods or services.

Opting out:

• Reply STOP at any time to unsubscribe. You will no longer receive messages from Miso.

• Reply HELP for information about the Service.

• Reply START to re-subscribe after opting out.

Standard message and data rates may apply depending on your wireless carrier and messaging plan. You are responsible for any charges your carrier imposes; Miso does not control these rates.

Your phone number is used solely to deliver the Service. We do not share, sell, or rent your phone number to third parties for their marketing purposes. See our Privacy Policy for more details on how we handle your data.

10. Third-Party Integrations

The Service allows you to connect third-party services (such as Oura Ring, Google Calendar, and others) to enhance your experience. By connecting these services, you agree that:

• You authorize Miso to access data from connected services on your behalf

• Your use of third-party services is subject to their respective terms of service and privacy policies

• We are not responsible for the availability, accuracy, or content of third-party services

• You may disconnect third-party services at any time through your account settings

For health-related integrations (such as Oura Ring), we access only the data types you explicitly authorize. This data is used solely to provide personalized features and is not shared with third parties. Health data is retained for 30 days and automatically deleted thereafter unless you request earlier deletion.

11. Intellectual Property

The Service and its original content, features, and functionality are owned by Sunod and are protected by international copyright, trademark, and other intellectual property laws.

12. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

13. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, secure, or error-free.

14. Limitation of Liability

To the maximum extent permitted by law, Sunod shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use the Service.

15. Indemnification

You agree to indemnify, defend, and hold harmless Sunod, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with: (a) your access to or use of the Service; (b) your violation of these Terms; (c) your violation of any third-party right, including any intellectual property, privacy, or health-information right; or (d) any decision you make, or action you take, in reliance on information the Service provides. This obligation survives termination of these Terms and your use of the Service.

16. Dispute Resolution

Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You agree to resolve disputes on an individual basis and waive any right to participate in class action lawsuits.

For claims under $10,000, arbitration may be conducted online or by phone.

17. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes by posting the new Terms on this page. Your continued use of the Service after changes constitutes acceptance of the new Terms.

18. Governing Law
